The Supreme Court issued notice on an applicant that sought the direction to the Centre to review 85 pesticides, apart from 99 that formed the subject matter of the petition seeking a ban on pesticides with immense health and environmental hazards. A bench comprising Justice ArunMisra and Justice Vineet Saran issued notice in an application initially moved by KavitaKuruganti that states that many of these 85 pesticides had not been reviewed by the AnupamVerma Committee that was set up to review the 66 pesticides banned in other countries.
The petitioner had moved the Apex Court in October 2017 seeking a ban in the 99 pesticides which were banned in other countries but still continued to be manufactured in India. Petitioners counsel Advocate Prashant Bhushan said a comparison shall show that the list of banned pesticides is actually 103 whereas the AnupamVerma Committee showed that the list was 66. The petition further prayed that the pesticides be reviewed by the review committee that should include independent health experts, state government representatives and also experts from the ecological agriculture field. It also prayed that the State government be empowered to decide on state level prohibition and restrictions on pesticides. Citing loophole in the legal system the petition said how an order to ban pesticides in Punjab, in early 2018 remained valid only for 20 days.
