The Apex Court declined to entertain PIL document by Adv Manohar Lal Sharma and another for registration of FIR or First Information Report on the basis of claims of sexual harassment, molestations, assaults or offences ejusdem generis leveled by the #MeToo platform, a movement via which women from different walks of life has come forward with their traumatic past experiences.
The PIL urging the Supreme Court (SC) to look into the said allegations also asked the Court to take suo motu action and to record the statements made by survivors on social media as part of the movement under section 154 of the Code of Criminal Procedure and for FIRs and criminal cases to be registered against the alleged harassers. Adv Sharma sought for constitution of fast track trial courts for time bound redressal of the grievances leveled along with demanding “#MeToo platform” to be treated as a practical source of first information in the case of such instances.
However, the CJI Ranjan Gogoi was recorded indicating that only the aggrieved individual may bring the law into motion. He remarked, “In any case, why should Manohar Lal Sharma come?” Whereas, Justice K.M. Joseph raised the question of jurisdiction in respect of cases where action is not taken.
