A Supreme Court bench comprising of Justice Kurian Joseph, Justice AM Khilwilkar and Justice DY Chandrachud ordered: “Having heard the learned counsel for the parties, we are of the view that the review petitions regarding the sentence needs to be considered afresh.” while considering the convict’s request for shifting him from Nagpur Central Jail to Aurangabad. Also, the authority was directed to consider his request within four weeks.
On the morning of August 21, 2007, the residents of Rupla Naik Tanda found four bodies floating in the village pond. A six-year-old male child along with two female children of ten years and a male child of two to four years were tied separately. A body of unidentified women below a boulder who was living with convict Sudam alias Rahul Kaniram Yadhav as his wife was also found. Due to absence of eye-witnesses, the trial court relying on the circumstantial evidence came to a conclusion that the man had committed murder of the four children and the women and order to cause disappearance of evidence of murder threw the dead bodies in the pond. The trial court had awarded death sentence to Sudam which was later confirmed by the High Court as well. The Apex Court also was of the view that the offence committed was heinous. Later in July 2012, the SC dismissed the review petition filed against the death penalty.
The bench scheduled the hearing of the review petition during second week of January, 2019.
