While hearing an appeal filed by V Venkatesan, who had been convicted for house trespass in order to commit an offence punishable with imprisonment for life, rape and criminal intimidation under provisions of Indian Penal Code, the Madras High Court directed the Director General of Police, Tamil Nadu to arrange for training sessions for all investigation officer throughout the state to sensitize them for handling cases involving sexual offences and other crimes against women.
Justice MV Murlidharan acquitted the accused, who was sentenced to 10 years rigorous imprisonment by a lower Court in a rape case and primarily blamed the “faulty investigation” for the same. The Court accepted several lapses in the investigation conducted by the police authorities and termed the “faulty investigation” as the root cause of the failure of the Prosecution. The Court also observed the failure of Prosecutrix to inspire confidence by the testimony and statements.
Owing to the faulty investigation, failure of Prosecutrix in establishing facts, etc the Court allowed the appeal, the accused, thus, discharged.
