Previously, the single bench of Calcutta High Court had permitted Bharatiya Janata Party to hold a rally or ‘Rath Yatra’ in different constituencies in West Bengal. Justice Tapbrata Chakraborty had allowed the BJP to hold rallies and set aside the refusal of the State Government on apprehensions of communal unrest.
The Division Bench of the Calcutta High Court, on Friday, comprising Chief Justice Debasish Kargupta and Justice Shampa Sarkar quashed the earlier order passed by the same court. It sent the case back to the single bench of the court and directed to reconsider the intelligence inputs given by the state government.
The earlier order directed the political party inclined to hold the rallies to inform the superintendents of police of respective districts, wherein the rallies would be entered, at least 12 hours before the schedule. It also directed the BJP to maintain law and order and to conduct the rallies in compliance with the law of the land by not causing any hindrances to the plying of vehicles.
The Chariots were meant to travel across 42 constituencies of the state in one and half months. This order was passed in favour of a move made by the State BJP who challenged the refusal of the State Government.
