The Apex Court, on Friday, was informed that a bill to amend electoral law in favor of NRI has been passed by Lok Sabha in August, 2018 and is likely to come up in Rajya Sabha in the upcoming Winter Session. The bill provides for allowing NRIs to vote through postal or e-ballots and is to amend the Representation of People’s Act. The division bench of Justice Madan B Lokur and Deepak Gupta was hearing petitions filed by Nagendar Chindam and other Non Resident Indians (NRIs). Nagendar Chindam is the chairman of London-based Pravasi Bharat organization. The matter has been adjourned for January 2019.
Lawyer P K Dey, appearing for the Centre, sought adjournment for six months on the ground that the Bill would be tabled in the Winter Session. However, the bench deferred the hearing by 12 weeks. The PILs advance the fact that 114 countries, including 20 Asian Nations, have already adopted the process of external voting further explaining that such a set-up could be achieved by allowing polling booths at diplomatic missions or through postal, proxy or electronic voting.
The Winter Session in the Rajya Sabha is to commence from December 12, 2018.
