The Supreme Court set aside the orders of Uttarkhand High Court which dealt with railway timings and connectivity in a form of public interest litigation. The Apex Court has been approached by the Central Government against the order of the Uttarkhand High Court where the high court bar association filed an affidavit on behalf of Indian Railways to extend train connectivity and flexibility in train timings. The Additional Solicitor General criticising this order, exclaimed that such an affidavit was filed”under compelling circumstances”.
The Supreme Court Bench consisting of Chief Justice Ranjan Gogoi, Justice Sanjay Kishan Kaul and Justice KM Joseph asserted that this issue is purely of a policy and it is so evident that the High Court has exceeded its jurisdiction. The SC Bench rejected the orders of Uttarkhand High Court on the basis that the matters regarding train timings and providing new service of trains are fundamentally the issue of policy which is to be decided only by the competent authority on a consideration of host of relevant facts and circumstances and therefore such issues are not relevant for determination in a Public Interest Litigation (PIL). The appeal against the High Court order was allowed by the SC in which it affirmed that if the Railways found it attainable and practicable to change the train timings and to provide new service, it has full freedom to do so.
