The Supreme Court observed today that it found nothing wrong with a deal the Narendra Modi government signed with France. The deal is to purchase 36 Rafale fighter jets. The deal was provided with a clean chit in all respects-decision- making, pricing and procurement procedure. The issue arising in this string of writ petitions, filed as PILs, relate to procurement of 36 Rafale Fighter jets for air force. The procurement in question, which has sought to be challenged, has its origins in the post Kargil experience that saw a renewed attempt to advance the strategic needs of the armed forces of the country. The judgment today came on four petitions that had asked the Supreme Court to set up a court-monitored probe into signing of the Rafale Deal alleging that the Modi Government not only overpaid for the said Jets but also promoted crony capitalism.
A three judge bench led by CJ Ranjan Gogoi said that the Court lacked the technical expertise to examine issues such as pricing and the choice of offset partners. The CJI also cited national security concerns to say that it could not step into issues such as defence contracts and procurements. The bench comprised of Chief Justice Ranjan Gogoi and Justices S. K. Kaul and K. M. Joseph on a batch of PILs filed by Advocates M. L. Sharma and Vineet Dhanda, Prashant Bhushan and former Union Ministers Arun Shourie and YAshwant Sinha and AAP Member of Parliament, Sanjay Singh.
