With the Lok Sabha elections round the corner all the parties of the country have already begun their rallies and advertisements. Top most parties of the country, such as BJP, Congress and Left parties of the states have started their preparations. The heats of the rally’s and hoardings have also started the tension between the parties effecting the civic body and peace in the states.
BJP the current ruling party of the country has planned 3 Yath Ratra in the state of West Bengal. For anyone to hold a Yath Ratra for any cause they need to seek permission from the state govt of the state. The state Govt after insuring that such rally or yatra will not make any communist riot or will create any kind of disturbance in the state shall allow such rally or yatra to be conducted.
BJP in its preparation for the Lok Sabha elections 2019 planned to hold 3 yath ratras in the state of West Bengal. As per the rules they need to seek permission from the state govt, which was subsequently denied by the govt stating it’ll be a “Danga Yatra” and not a yath ratra. The govt also claimed that the yath ratra is likely to disturb the communal peace of the state
Upon denial of the permission to hold rally BJP moved to Calcutta HC, where it got the permission to hold such yath ratra. This order was overturned by 2 judge’s bench of the same court and directed the single judge bench to reconsider its decision based on the states intelligence inputs.
BJP moved to Supreme Court and filed a petition against the order of HC and denial of permission by the state govt of West Bengal. BJP in its current petition claims that unnecessary restriction imposed on them violates the fundamental rights of the party.
The party alleges that denial of the permission to hold rally was done arbitrarily and unconstitutionally. The petitioner claims that the democratic right of the party to hold different political programs in the state has been infringed. BJP also claimed that this decision of the current government is backed for the reason that BJP is the main opposition party for the upcoming Lok Sabha elections.
BJP also alleged that there has been lawless situation in the state since 2004 where Trinamool Congress has been ruling since then. Targeting the government officials and the executive the petitioner also contested that the executive has been working as political agents of the ruling party and thus did not reply to letters sent by BJP seeking permission for conducting rath yatras. Supreme Court has further listed this matter to be heard on 15th January 2019 for hearing.
