The Supreme Court found a petition seeking the probe into the matter of selective targeting of Muslim Extremists in the state of Gujarat. Late Journalist BG Varghese, Lyricist Javed Akhtar and a social worker Shabnam Hashmi filed this petition before the supreme court. Subsequently, the Court issued a notice to the state which constituted a special task force and a monitoring authority consisting of persons who had held higher positions in the Judiciary, Police and scientific investigation.
Former Justice HS Bedi was made the chairperson of the monitoring authority, and the Special Task Force submitted the report comprising 224 pages, which marshalled relevant the facts and circumstances to the monitoring authority. Indeed, friendly discussion regarding the collected evidence occurred between the monitoring authority and the representatives of the deceased; and the representatives were free to appoint their legal counsels for dealing with the matter before the monitoring authority.
After a thorough analysis of the report, the monitoring Authority submitted the final report to the respective parties to file their replies. In light of the contents mentioned in the final report, Justice HS Bedi suggested necessary action be taken against the police officers only when:
Further, the Monitoring Authority set the standards by itself for deciding the quality of evidence that may be submitted before it. The standards shall not be as strict as that in the Court of law because the Monitoring Authority does not adjudicate upon the matter, rather only finding if there is a prima facie case to justify a trial. This is in accordance with section 228 of the Code of Criminal Procedure.
The former DGP of Gujarat Shreekumar levelled various allegations in regard to selective elimination of the Muslim Extremists. However, the report found out no relevance between the allegations made by him and the seventeen cases at hand. Since the allegations of Muslim Extremism has nexus only with one case—Sameerkhan and the victims belonged to various states such as Kerala, Maharashtra, Uttar Pradesh, Uttarakhand and Madhya Pradesh, the allegations were found to be false. However, the only commonality which the Monitory Authority could find was the varying degrees of criminal wrongs among the cases.
