An NGO named ‘Common Cause’ filed a Public Interest Litigation against the Centre’s appointment of Nageshwar Rao as the Director of the Central Bureau of Investigation. It is pertinent to note that the Supreme Court had quashed the order of the Cabinet Appointment Committee, which made Nageshwar Rao as the Interim Director of the CBI. Despite invalidating the order, the union government continued to execute the earlier order. RTI Activist Anjali Bharadwaj, who is also a co-petitioner in the PIL, has alleged the absence of transparency in the appointment process.
According to the petitioner, the appointment contravenes section 4A of DSPE Act. The petitioner said that there were no recommendations from the high-level committee to appoint Nageshwar Rao as the CBI Director. Therefore, the process of appointment by the Union Government contravened the procedure provided in the DSPE Act.
Further, the petition alleged that the Union Government is making attempts to curb the independence of the CBI Institution by making an illegal and arbitrary appointment. Additionally, the zero transparency in the process sheds light on the undue influence by the union government on the institution.
In light of the submissions made, the petitioner prayed for quashing the appointment order and sought directions for the guidelines/mechanisms which would ensure transparency in the appointment process. Despite filing several RTI applications regarding Alok Verma, the union government continued to respond with the same summary, and this exhibited the obfuscation in the appointment process.
