In a bunch of petitions filed by various bar owners of Mumbai & Bharatiya Bargirls Union which challenged the Maharashtra Govt’s Legislature Act known as - Prohibition of Obscene Dance in Hotels, Restaurants and Bar Rooms and Protection of Dignity of Women (Working therein) Act, 2016.
The petition by Bharatiya Bargirls Union in March 2017, alleged the Maharashtra State Govt off imposing complete ban on dance bars. The Maharashtra Govt argued that the new law was brought in for licencing purposes and to safeguard the interests of women employed at such dance bars,
The division bench comprising Justice A. K Sikri and Justice Ashok Bhushan of Supreme Court while listening to the petition observed & held that total prohibition of dance bars in Maharashtra cannot be done. Stringent conditions imposed by the Government for getting license for dance bars were also relaxed by the court.
The Court in its judgement delivered on 17th Jan 2019, made following decision in regards to the “Maharashtra Prohibition of Obscene Dance in Hotels, Restaurants and Bar Rooms and Protection of Dignity of Women (working therein) Act, 2016 “
The court Quashed following rules from the Act.
Allowed giving direct tips to girls working at Dance Bars.
