The newly enrolled lawyers did a callous act by bursting crackers at the Madras High Court during an enrolment ceremony. The Madras High Court had informed and requested the Bar Council of Tamil Nadu and Puducherry to restrict the enrolment as the enrolment ceremony would take place frequently. Special Committee members R Singaravelan and N Chandrasekharan have played a greater role by passing orders against unlawful and anti social practices in which the newly enrolled candidates were readily involved.
BCTN authorities had catered to the fact that the bursting of the crackers led to the violation of the undertaking signed by the candidates where they had pledged not to print or publish posters, pamphlets, invitation cards, advertisement and allied notifications.
“Are all the applicants for Enrolment who resorted to grand function on the Road at the cost of Public interest have take part in any public interest oriented activities…or are their parents… ‘Thiyagies’ who got independence for the Nation to celebrate their Enrolment?”
The BCTN issued the following orders, for the welfare of the state and the advocates.
It is significant to note that the enrolment certificates given to those on December 21 will be subjected to verification and scrutiny. It has also been mentioned that. Enrolment functions should be conducted on Wednesdays and Saturdays. It had also ordered that not more than 150 candidates could be enrolled in a week and only 75 candidates should be enrolled at a time. Only the parents or any two siblings of the candidate will be permitted to stand in the Bar Council premises during the time of enrolment and had also ordered to not burst crackers during a ceremony.
The anti-social act committed by the candidates demanded stringent punishment but however BCTN decided to handle the matter in a lineantway insteadcatering to the notion that the 534 candidates who enrolled could donate at least Rs 1,000 towards the Chief Minister’s Relief Fund for Cyclone Gaja rehabilitation efforts which was a discretionary method and was not binding and mandatory. It had also mentioned that in future coercive measure would be taken in order to curb such menace. It had also mentioned that not abiding by the rules would lead to disciplinary proceedings and disqualification. In order to curb such violation BCTN had ordered the lawyers to pay an amount of Rupees 10,000 to Bar Council Welfare fund.
