The States were directed by the Supreme Court to implement the programs of Reformation and Rehabilitation which are in the Model Prison Manual of 2016. The Ministry of Home Affairs has approved the Manual which refers to the education of the prisoners which play a vital role in the overall development of the prisoners. Physical educations such as Yoga, health education, moral and spiritual educations are also within it.
The bench which comprised of Justice SA Bobde, Justice L.Nageswara Rao and Justice R.Subash Reddy stated that “There is no material on the record about how many States have adopted the Manual. We are directing the States to consider implementing reformative and rehabilitation programmes contained in the Manual. In addition, it is open to the States if they want to adopt any kind of correctional measures.”
In a minor’s rape and murder case the court, while commuting from death sentence to 30 years imprisonment without any kind of remission, the bench has noted Justice Krishna Iyer’s suggestions made in the case of Rajendra Prasad v. the State of UP. He stated that “In a short run the Social defense against these murderers is best ensured by caging them but in the long run, we can attain by any method which includes neuro-techniques of which we have a rich legacy with the help of which there can be transformation through re-orientation of the inner man. We can use the yogic treasure to experiment with on high risk and high strung murder merchants if the prison system will talk native language. With the help of Yoga, Neuroscience and Meditational technology we can find many splendid answers. Hanging is cheaper than healing a party but the human life is dearer to be swung dead save in extreme circumstances.”
The Court has then asked the Maharashtra State regarding its reformation and rehabilitation station steps of its prisoners for which the state replied that Yoga and Meditation classes have already been issued circulars to get started so that the inmates physical and mental health improves. They even said that programs like Prerna Path for which people like Ram Dev Baba were invited are being held for motivating the prisoners to participate in the Yoga programmes.
