In a 28 Page write up styled as ‘affidavit’, the former employee complains that she and her family have been victimized for resisting the unwanted sexual advances of the CJI. In her affidavit, she narrated the job environment from the day she joined the court as a junior court assistant. She was posted at the residence office of Justice Ranjan Gogoi.
According to the women she was transferred thrice in a matter of weeks and later on 19th November 2018, a memorandum was issued to her informing that disciplinary enquiry has been initiated against her and finally got dismissed in December 2018. Her husband who has been a Head Constable with Delhi police since 2013 was suddenly transferred from the crime branch division. She was arrested on the basis of an accusation that she had taken Rs 50,000 from a person in 2017 promising to secure a job for him in Supreme Court but failed to do so.
A three-judge bench of Supreme Court comprising of CJI, Justice Arun Mishra and Justice Sanjiv Khanna held a special sitting to deal with the matter of great public importance touching upon the independence of the Judiciary. The CJI in response to the allegation commented that “This is the reward CJI gets after 20 years of service and a bank balance of 680,000. Independence of judiciary is under very serious threat. If the judges have to work under these conditions, good people will never come to this office.”
The SC secretary-general in his reply of mail to several media houses pointed out that the women in course of posting at home office of CJI and even thereafter never made complaints of the nature being alleged by her now. The SC in its reply termed such complaints to be not only mischievous but also a complete afterthought of her to make these false allegations at this time. The Court said that an appropriate Bench will hear the sexual harassment allegations.
The Delhi High Court in a police plea to cancel the bail of former Supreme Court employee said that it would heat on 24th April 2019. The cancellation of the bail granted to the woman is sought after the complainant claimed that he was being threatened by her. Complainant Naveen Kumar earlier alleged offences that the former apex court employee had defrauded him of Rs 50,000 which she took as part of a bribe in return of promise to secure job at Supreme Court by but no such job post was given. An FIR for the alleged offences of cheating, criminal intimidation and criminal conspiracy was lodged against her. The woman was arrested by police but was out on bail.
