In the time of Lok Sabha 2019 elections where fake news is at its peak and political parties are fighting tooth and nail to secure their victory whether through legitimate means or through illegitimate means. Amidst all this the Calcutta HC dismissed a PIL seeking a direction to government to frame policy against broadcasting of fake news.
The division bench of HC at first acknowledged the fact that the PIL filed by Raju Ray is not unjustified in pointing out that uncontrolled statements through the audio-visual media may not be conducive to proper management of the different communities and regulations ought to be considered for bringing it to place. However, adding up to above comment the bench said that it is a matter of governance and primarily for the competent legislative bodies to decide appropriately.
The court did not made any order or gave any direction by saying that “It will not be within the realm of the court to conclude as to whether any particular statement in the print media or the audio visual media is fake or not.”The bench before dismissing the petition remarked in its judgment that “we are not inclined to guide the government in the matter of formulating a policy or making a law. It is a matter for legislative bodies and those authorized executive functionaries reposed with the power to make such regulations to put in place and operate.”
