The PepsiCo Holdings India Limited has withdrawn all of its nine cases which were filed against farmers in Gujarat on charges of infringing its potato variety. PepsiCo in the city of Ahmedabad had filed a suit against four farmers for permanent injunction to restrain these farmers from infringing its plant variety. Along with this, PepsiCo sought interim injunction and damages worth 1.5 crore from each of the four farmers.
Apart from these four farmers cases were filed against five more farmers which too were withdrawn in the Modasa district Court.Also, two other cases against large farmers and traders were withdrawn in a Deesa court this week.
PepsiCo stated that, it is the registered producer of the breed of potato plant variety called ‘FL 2027’ (commercial name FC5) and it is used in the manufacture of Lays chips. The company claimed that their statutory rights under the provisions of sections 64 and 65 of the Protection of Plant Varieties and Farmers’ Rights Act, 2001, were being violated by the farmers.
However, it stated before the Ahmedabad City Civil Court that, PepsiCo was willing to grant the licenses to the farmers for the use of the potato plant variety. In addition to this they were willing to drop the charges and not pursue the damages.However, the judge had granted interim relief in favour of PepsiCo.
This action brought in state wide uproar claiming the injustice done to the farmers and the behavior of the company.
