An 8 year old girl who was raped and murdered by in a temple in Jammu and Kashmir in Kathua District last year. Her father shook the Punjab and Haryana Court on Wednesday by seeking enhancement of the sentence imposed on the six convicts and also challenged the acquittal of one accused.
The council Utsa Bains said the petitioner requested the court to magnify the punishment from life imprisonment to capital punishment of the convicts Sanji Ram, Deepak Khajuria and Parvesh Kumar.
The petition stated “It is the rarest of rare cases as per the standard that by Supreme Court the case of rape and murder by Gang of a minor child comes under this category more so when the manner of committing crime exhibits complete insensitivity, cruelty, depravity and perversion.”
In addition to the above requests to enhance the punishment the petitioner also requested to increase the imprisonment time from 5 years to life time for the convicts Surinder Kumar, Tilak Raj and Anand Dutta.
The court in Pathankot had ordered a life time imprisonment till the last breath to Sanji Ram, the care taker of the devastanam( temple, where the hideous incident took place last year January), Deepak Khajuria, a special police officer and Parvesh Kumar, a civilian for the gangrape and murder of Asifa.
They were convicted according to the Ranbir Penal Code (similar to Indian Penal Code which is followed only in Jammu and Kashmir) under sections relating to the criminal conspiracy in murder, kidnapping, gang rape, destruction of evidence, drugging the victim and common intention.
The trial court acquitted the son of Sanji Ram, Vishal Jangotra and the other three accused (Sub Inspector Anand Dutta, the head constable Tilak Raj and special police officer Surender Verma) were sentenced to 5 years prison time
The eight year old girl was kidnapped on 10th January was raped in a small village temple after keeping tranquilised for four days she was cudgelled to death.
