Government seems to have simplified the rules for filing of patents for small startups,womens and Government entities.It has also promoted the Indian companies who apply for patents abroad. Earlier, a certain fee was required to be paid for electronic international application under the Patent Cooperation Treaty and the transmission through the WIPO (World Intellectual Property Organization).
Few days back, there has also been a few guidelines changes for the patents in the academic institutions which says, if there has been any invention by any student or researcher by using the funds and resources of the institution.The patent rights will go to the institution.Whereas if it was done outside the working hours of the institution and the product was invented without the use of any of the resources by the institution the patent rights shall be with the student or researcher.
PROTECTION OF PATENT ABROAD.
A patent for a particular country is valid only within the territories of one's country.If a person wants to save their patents rights.
For instance: An Irish patent can stop others making, selling or using a person's invention in Ireland but because patents are territorial in effect, an Irish patent is only valid in Ireland and does not afford the holder protection elsewhere.
If a person is willing to sell their invention outside Ireland.They will have to get the patent rights of the other country also. So if in case any misutilization has happened of their patent. They can defend their rights and also can determine the market share.
It should also be noted that the international filing fee is reduced and if the application is filed in electronic form, a patentee can get protection in individual countries in Europe by applying to the national office of each country. This is done only when a patentee want protection in a few countries. A patentee get advice from the national patent office of any country a patentee want protection in.
