Three months after Supreme Court order, 14,000 Amrapali home buyers await registration
The supreme court in an order passed on 23rd of July relating to the registration of amrapalli home of more than 14,000 buyers.
In the Amrapali matter the Supreme Court cancelled the RERA registration of their projects and also barred Noida and Greater Noida authorities from selling flats of home-buyers to realize their dues; and appointed NBCC (a PSU) to complete the projects pending for years. This has ignited a ray of hope amongst thousands of Amrapali home-buyers.
The Hon’ble Supreme Court also dealt with the issue of delayed projects and stuck homebuyers.It questioned the conduct of the Authorities and gave directions to both, the Central Government and the State Governments, to take appropriate steps to resolve the lingering issue in a time-bound manner.
Three months after the supreme court has allowed the noida authorities to continue the registration of several projects of the amrapalli homes the homebuyers are still waiting for the action.
Some of the buyers who tried for registration had to wait for longer than expected.
The registration was supposed to be folowed by a tripartite agreement which need to be taken place between the buyer,the authority and the court receiver who would later appoint a signatory.
On Sunday night, some buyers said they had received a verbal reassurance from Venkatramani. “He reassured us during a meeting tonight that the registration will start immediately and is likely to commence from the coming week,” Kant added.
There has also been some issues raised by the homebuyers about floor area ratio allocation.
There are several discrepancies which has been received firstly the flats are smaller than it was mentioned in the buyer's agreement,so the buyer's will be liable to pay for the area finally being given.
And secondly the commercial structure of the amrapalli homes,but according to the sources all the amrapalli homes has shops and stores allocated.
The Noida authority waited for clarity for almost 3 months on issues such as who will complete the buildings for the which flats would be registered occupancy certificates to be issued.
According to the reports of the buyers the amrapali group had also offered possession to buyers in incomplete or partially complete projects which were never completed later.
Also one of the reasons for the delay was there was no record of the amount payed by the homebuyers to the builders and also the dues and without it they couldn't have entered into the agreement of registrary.
