Recently, in the ongoing prison reforms case, which was brought before by the bench consisting of Justice Madan B.Lokur and Justice Deepak Gupta, Gaurav Agrawal had filed an application seeking an approval of open prisons based on the Rajasthan model by opening at least one open prison in every district of the country.
The bench had taken all the details pertaining to the Open prisons in Rajasthan and had asked the Centre to invite the researcher and activist Smita Chakraburtty behind the model in order to take her advice on opening up an open prison on every district before getting into the conclusion. The Attorney General had assured the court that the activist will be invited regarding her opinion on the open prisons.
Attorney General, K.K. Venugopal held that prior to any action by the Centre, the states should first look into the matter. The central government can take a stand only after taking into consideration the views of State government.
The bench had held that in order to implement the proposal effectively and efficiently the Centre should hold a conference with the State Directors General of Police. The Court had also issued certain directions pertaining to the manner in which the meetings should be conducted which has to be followed by the Ministry of Home Affairs, National Legal Services Authority also known as NALSA and also where the activist and researcher who was the main reason behind this whole picture Smita Chakraburtty will also be included.
