This is the first case in Uttar Pradesh in which a builder has been detained under the stringnet National Security Act (NSA).
Few month back the Chief Minister, Yogi Adityanath said "that all builders responsible for illegal construction and playing with life of thousands of residents should be sent to jail and booked under the NSA. A list should be prepared of the officials involved in land related matters so that strict actions could be taken against them, the CM said during a meeting with NoidaGreater Noida and Yamuna Expressway".
He added that a list should be prepared of all the officials responsible for the construction done after 2014. He further instructed that there should be forensic audit of the unsafe construction and these constructions should be demolished immediately. Safety of the residents is of utmost priority. He further instructed officials to pursue the cases in court with the best legal resources and in the best posible way.
Khan a builder who is from meeerut,has been detained under Section 3(2) of the NSA according to which the magistrate has the right to take preventive detention for upto one year if that person is found to be disturbing public order in the district. The magistrate categorized khan under a 'rogue builder' category and said similar actions will be taken against errant builders. According to a report the district officer noted that the buildings in shahberi have been built without any necessary clearances. The structure is weak,no map appearances or no building plans cleared. Builders are also being held responsible for any acts against public order.
According to the reports made by the officials it was concluded that many of the buildings came without any proper approval. Over 86 FIR's have been registered over illegal construction in shahberi and action are taken against around 42 builders. Maan,a builder from noida has constructed a lot of flats illegally in the past few years and sold them. The building lacked any proper construction and poor quality of material was used.
In an interview the district magistrate told to the reporters "The decision to slap NSA on Maan has been taken on the basis of a report from the district police. His bail plea is due to be heard in court soon and if he is granted bail, then there are reasons to believe that he would engage in selling the remaining flats, leading to public disorder." The message is very clear strict actions are being taken against the rogue builders.
