The hon’ble SC held on Monday set up a mediation team headed by Senior Advocate Sanjay Hegde to talk with the anti-CAA protestors at Shaheen Bagh to clear the road blockade. The Shaheen Bagh protest being held for the past sixty days at Kalindi Kunj road which plays a vital role for lakhs of commuters every day. The bench comprising of Justice SK Kaul and Justice KM Joseph on petition being filed by Sahi and Garg seeking the road clearance of Shaheen Bagh protests made it clear that Hegde has the discretion to choose other two persons in the mediation team. At the hearing Justice SK Kaul explained the right of exercise of balance during the protest. "Blocking traffic and causing inconvenience is our concern. My concern is if everybody starts blocking roads, maybe due to genuine concerns, where does it stop", Justice Kaul observed.
On February 10, the bench had issued notices to the petitions stating that the protest cannot go for an indefinite period and protests must be held in places where it is designated for protests. The bench also mentioned previously that it does not have any obligation of protests being held peacefully and which do not bring inconvenience to the public. Despite of the apex court’s notice the anti-CAA protestors are continuing their protest. In the previous hearing the petitioners urged the court to pass ‘some’ directions as it was causing a huge menace to the public at large. Thus, the apex court sets up a mediation team to hold talks and come to a conclusion at common interest.
The Solicitor General Tushar Mehta suggests the court by asking them to discuss on the court’s suggestions and inform. The court asked the centre to give any other alternate suggestion to conduct the protest. The SG also mentions that since the court cannot give suggestions, this shall not be their ground to contention to continue their protest there itself. The SG was also very keen in not giving them an impression that the institution was bending towards the protestors and held that there wasn’t any visible leader to the protest as the group was keeping the women and children in the front. He claimed that there was a complete blockade as to even essential services like ambulance, buses and school vans were not allowed in the said community. The said matter is posted on February 24.
