The recent press conference held by the four senior Judges of the Supreme Court, namely Justice Chelameshwar, Justice Kurian Joseph, Justice Ranjan Gogoi and Justice Madan B Lokur on the 12th January of 2018 has sent ripples across the country and pointed out to the dwindling integrity of the highest judicial institution of the country. The BCI has called this conference an ‘unfortunate step’ which may topple the faith and trust of the people in the judiciary.
The Conference comes as an indication of a rift within the judiciary itself unlike the usual dissension between judiciary and the government. The press conference comes in the wake of petitions filed by the NGO CJAR and various other lawyers alleging the inherent conflict of interest in the hearing of the medical bribery case by the Chief Justice in view of the fact that he dealt with a case involving the Prasad education trust running the Lucknow medical college, a party in the bribery case.
This case has triggered the questioning of the manner of allotment of benches to various cases by the Chief Justice. Justice Chelameshwar has pointed out that ‘things less than desirable’ have been happening although Justice Gogoi and Kurian have gone on record to say that this matter doesn’t need any political intervention and they only expressed their dissatisfaction through the press conference as a last resort. The CJAR in consonance with its petitions has come up in support of the four judges pointing out the fact of abuse of power by the Chief Justice for allotting the benches in politically sensitive cases in manner in an arbitrary manner.
The BCI passed a resolution hoping that such a dissension within the judiciary wouldn’t invite intervention from political system and weaken the integrity and independence of the system. The BCI has also constituted a 7 member delegation to meet with the judges. The committee includes-Mr.Manan Kumar Mishra, BCI Chairman Mr. S. Prabakaran, BCI Co-Chairman Mr. Vijay Bhatt, BCI Managing Trustee and Member Mr.Apurba Kumar Sharma, Chairman of BCI Executive Committee Mr.Pratap C. Mehta, BCI Associate Managing Trustee and Member Mr.Rameshchandra G. Shah, BCI Member Mr. T.S. Ajith, Member, BCI with the vice chairman of BCI SatishDeshmukh as special invitee.
