The Kerala Government promote the 'Epidemic Diseases Ordinance 2020'
With the increasing fear of the COVID-19 pandemic, the state Government promotes the 'Epidemic Diseases Ordinance 2020' with the purpose "to unite and combine the laws relating to the regulation and prevention to avoid such epidemic diseases".
By means of the decree, "Epidemic Disease" means any disease or infection declared as widespread occurrence of an infectious disease by announcement published in the official gazette, by the Government.
Section 4 of the Ordinance gives special power to the Government like "special measures and specify Regulations as to widespread occurrence of an infectious disease ".
The Section enables the government to take necessary methods such as:
(a) To forbid any usage or do something which the Government believe adequate to spread or transmitting of this epidemic diseases from human to human in any meeting, celebration or other such activities within the State;
(b) To examine all the people entering into the State by any means of transportation in quarantine or in isolation, as the situation may be, in hospital, temporary accommodation, homes of persons suspected of being infected with any such occurrence of an infectious disease by the officers authorized in the guideline;
(c) To close State borders for such time period as can be deemed necessary;
(d) To impose required necessary restrictions on the operation of transportation by public and private individuals;
(e) To lay down social distancing norms;
(f) To limit or prohibit people attending worship in public places and religious institutions;
(g) To control or restrict the functioning of offices, Government and private, and educational institutions in the State;
(h) To lay down ban or restrictions on the carrying out of shops and commercial establishments, factories, workshops;
(i) To limit duration of services in emergency services such as banks, media, health care, food supply, electricity, water, fuel, etc.;
(j) Such other processes may be necessary for the regulation and prevention of epidemic diseases as strong-willed by the state Government.
Breach of the Regulations and violation of these above mentioned instructions is punishable with imprisonment for a time period which may extend to two years or with penalty which may extend to Rs.10000 or with both.
This particular offence is cognizable and bailable.
