Karnataka agrees to allow passage for Non- COVID19 patients from Kerala
A day ahead of the Supreme Court hearing on the issue of road blockade between Kerala and Karnataka border, Karnataka agreed to allow passage of patients from Kerala, who are not infected with COVID-19 in order to avail medical services from hospitals in Mangalore. This was announced by the Kerala Chief Minister in his press briefing on monday evening. After the 21 day National lockdown was announced on 24th March, the Karnataka government erected mud embankments on the arterial inter-state roads to Kerala. The order was passed by considering a Special Leave Petition filed by Karnataka against the Kerala High Court’s order directing the removal of border blockade to allow passage for patients from Kasargod district seeking medical services in Mangalore. Earlier, seven patients had died when Karnataka police denied entry of ambulance in the state of Karnataka. The Kerala HC had held that Karnataka’s road blockade would lead to violation of Article 21 as well as Article 19(1) (d). The Kerala HC passed the order directing Karnataka government to remove such blockade and allow movement of patients, however the Karnataka government appealed the SC in the matter seeking Centre intervention in the matter.
Thus, the Supreme Court closed the matter on Tuesday. But the entry will be subjected to some parameters. The passage will be subject to medical examination by a medical team at the Talapadi check post, Karnataka border. The entry to Karnataka will be only for patients in critical cases such as accidents and the entry would be only in Government ambulances. Moreover they should have a medical certificate from a local doctor certifying that the patient is not infected with COVID-19 and also certifying that no medical treatment for the patients is available in Kasargod or Kannur districts.
