The State of Tamil Nadu and the Bar Council of Tamil Nadu and Puducherry has received a notice by the Madras High court, seeking minimum financial assistance for advocates and their registrated clerks.
The petition was appealed through the writ of mandamus, directing the Bar council of Tamil Nadu and Puducherry, to provide and release a sum of Rs. 50000 to Rs. 25000, respectively for both the advocates and their registrated clerks in the state of Tamil Nadu.
Dr. A. F Chelliah, a senior advocate in Chennai filled this petition as a request, to take up this petition as a priority basis case to the Bar council of Tamil Nadu and Puducherry and the State of Tamil Nadu, were it was requested to provide with financial assistance as per the said request.
The Bench for this petition was taken up by two Uustices, Vineet Kothari and R. Suresh Kumar via Video Conferencing due to the national lockdown, in view of the COVID-19 outbreak. However, due to the absence of Dr. A. F Chelliah on phone, the Affidavit of the Petitioner, including the letter addressed by him to the Bar council of Tamil Nadu and Puducherry was persuaded by the court.
P. H Arvind Pandian, Additional Advocate General took the case for the state and private notice was served to the Bar council of Tamil Nadu and Puducherry.
The court observed that at this situation it was only appropriate to issue notice and directed the Respondent to file a report and Counter within 2 weeks regarding the financial relief that could be granted to the Advocates and their Registrated clerks.
Though, a counter has been asked by the court for the said petition from the Respondent within 2 week, but should any assistance be given to this class of people seeing the emergency situation and paralyzed court performance, is a question in view.
