Ever since the constitution of Aam Aadmi Party has taken place, founder Arvind Kejriwal is facing a lot of difficulties, but today it was different. AAP today saw a turnover of circumstances wherein the division bench of the Delhi high court ordered the election commissioner to file a written reply containing the facts leading to disqualification of 20 AAP MLAs and has set February 7 as the next date of hearing. The division bench is resolute about detailed affidavit from the commission on its decision.
Yesterday the High Court while transferring the pleas of disqualified MLAs to the division bench, also extended an interim order to the commission for non-issuance of any kind of notification for by polls in Delhi. According to the sources, “the disqualification necessitates by polls in the 20 Delhi Constituencies the MLAs are from”.
The above disqualification was initiated by plea filed by Advocate Prashant Patel. The high court not only ordered for non-announcement of bypolls in Delhi assembly but has also summoned records related to proceedings leading to the recommendation of the commission to disqualify the 20 MLAs. Relating to the last week incident, AAP legislators moved to the court against their disqualification to which the president of India gave his assent dating January 21. Two days before happening of such incident, election commission made an early step in notifying President Kovind about its recommendation to disqualify particular MLAs of the party for holding the office of profit.
Out of the AAP reputed legislator, five of them, has clearly alleged that the commission has acted in “undue haste” and without “affording” the “reasonable opportunity of a fair hearing” to the petitioners. Not only had this but they also alleged the election commission of not been considerate about the post of “parliamentary secretary” which they related it as general and a mere post and not an “office”. According to the leading news journal “AAP has appointed 21 of its Delhi MLAs as parliamentary secretaries in 2015 soon after it won a majority in the Delhi Assembly Polls. One of the 21 MLAs, Jarnail Singh has already resigned”.
