The Competition commission of India on Thursday imposed a penalty of Rs. 135.6 Crore on google while giving the ruling with a majority of 4-2 in a case of 2012 filed against the world’s renowned search engine by the Indian companies namely matrimony.com and the Consumer Unity and Trust Society (CUTS) on the ground that google was using its dominant position abusively by creating a bias in search results.
The fine was formed by calculating 5% of its total average revenue from India in the financial year 2013 to 2015, and the same was ordered to be submitted in the next 60 days.
It was alleged by the complainants that google operates search and advertising services in a discriminatory manner by manually manipulating its search results which affects the advertisers and the users. In the response of which the respondents contented that each and every function of google is focused on innovation to support the needs of the customers, for which it also complies with the Indian competition laws in most of the instances and we are working on the narrow concerns identified by the CCI.
The CCI in its order said that “ google was infringing anti-trust conduct”. It was also observed that being the single gateway to the internet and for having a vast majority of users it has a responsibility to discharge and if it runs its business in an unfair and discriminatory manner and creates an uneven playing field for others will be undoubtedly illegal.
Even in European Union in July 2017 google’s parent company was fined an amount of $2.9 billion for abusing its dominant position.
