Delhi High court has issued notice in a plea seeking the release release of 916 foreign nationals, who participated in the religious congregation at Nizamuddin Markaz event and are held in institutional quarantine despite being tested negative for COVID-19.
In the plea, the petitioners are represented by Senior Advocate Rebecca M John, and Advocate Ashima Mandla has asked the court to order the Delhi Government to order and facilitate the immediate release of foreign nationals held in institutional quarantine in Delhi who have been tested negative for covid-19 as quarantine in perpetuity.
Delhi High Court Division bench of Justice Vipin Sanghi and Justice Rajnish Bhatnagar instructed the petitioner to record the details of the facilities listed by the community for the transfer of these foreign nationals and to notify the authorities about the same. This order was issued pursuant to a submission made by Senior Advocate Rebecca M John, who stating that the petitioners confined the relief sought in the present petition only to pray that certain foreign nationals could be transferred to other better facilities established by the community.
In addition, Mrs John argued that she would provide the details of the said facilities and also record them and that the facilities could be inspected by the Respondents and said that foreign nationals and the community would make all arrangements for the facilities at their own expense. The Delhi Police Crime Branch has informed the Delhi High Court that not a single foreign national associated with the Tablighi Jamaat incident has so far been arrested or taken into custody by the Delhi Police. The Delhi Police also told the court that more than 900 international participants in Tablighi Jamaat, including the petitioners, had entered the investigation of the case and obtained notices under CrPC Section 41A.
The investigation itself is being conducted on a daily basis and every effort is being made to finalize the investigation and to submit a report pursuant to section 173 of the CrPC. According to that article, the foreign nationals concerned made an undertaking to the Delhi Police that they would not breach the conditions set out in Section 41(a) of the CRPC and comply with the terms of the notice. The status report also notes that: in order to explain the validity of their visit to India, the passports of 723 accused foreigners and the identity cards of 23 accused Nepal Nationals have been released.
