Due to the ongoing migrant predicament, the government is ready to redefine the term “migrant workers” following 41 years & is planning to enroll them to have access to social security and safety with health benefits as per the Employees state Insurance Corporation.
The new steps, which pursue large scale migration of lakhs of workers – for both formal and informal economy during this lockdowns, are projected as per an updated code and social security which the ministry of labor will take to the union cabinet. The centre is scheduling to pass a law on this by the time year ends. The labor minister Santosh Gangwar corroborated that the legal structure was being reinforced and some of the proviso in the projected code, clarified by the standing committee of parliament lead by BJD MP Bhartruhari Mahtab, might go through further modifications.
The measures are seen to be critical as the present legal structure is not adequate, something that was out in the open by the emigration of migrants, without any presence of any kind of record of employment which prompted a stern sense of rethinking for the government. The Inter-State Migrant Workmen Act, 1979 applies to establishments with 5 or more inter-state migrant workers & to the contractors related in hiring them. “This means that most of them (migrant workers) will be outside the law’s realm,” said an official.
The planned legal structure will be applicable to individual migrant workers who are earning a particular amount along with domestic support included in its structure as well. These workers will have the advantage of portability of advantage over the country and will be given the right to have the fare to visit home once every year, according to the sources. The centre at present is trying to make it look attractive for workers to enroll by putting away social security advantages, such as healthcare & pension, while also requesting them to stipulate if they are migrants.
