On Tuesday, the premium investigating agency’s sincerity was again questioned by the Bombay High Court on the alleged fake encounter case of Sohrabuddin Shaikh, Tulsiram Prajapati and Kausar Bi.
CBI’s challenge towards discharge of certain police officers in the said case has been heard by Justice Revati Mohite Dere. The deceased Sohrabuddin’s brother Rubabuddin has also challenged the discharge of senior police officers who were accused in the case. The plea regarding the discharge is been heard by the court on day to day basis.
Justice Dere was angry while questioning the CBI’s responsibility to ensure that its witnesses are protected so that they can be deposed against the accused fearlessly. Pointing on it, the responsibility of CBI doesn’t end simply at filing the charge sheet. It is the duty of the CBI to protect their witnesses. These questions were made towards the ASG Anil Singh, who is appearing for the CBI matter in this case.
ASG Singh took a whole lot of time to sought and file a reply to court queries to which Justice Dere said that the CBI being such a premium agency cannot remain a silent spectator and blamed the CBI for every kind of negligence and non-assistance caused to the court. This is not the first time that a high court has questioned CBI on its sincerity towards its investigation.
According to the sources, a total of 38 accused were named in the CBI’s charge sheet including the BJP leading national president Amit Shah. Out of these, 15 have already been discharged from the case by trial court. Out of the 40 witnesses examined, 34 have already tuned hostile. What made these observations more significant was the fact “that two more witnesses had turned hostile and refused to support the CBI’s case in the Special CBI Court which is conducting the trial.
