A Delhi court on Monday refused to put a gag order on media from reporting on sexual harassment charges against ex-TERI chief RK Pachauri. Additional District Judge Sumit Das refused to restrain media from reporting on the subject and vacated the order passed by his predecessor which has directed media to not publish any interview or speak against Pachauri, the order said that the media is required to mention in subtitles that in any court the allegations haven’t been proved while it publishes any interview or speak against Pachauri. This order has been rejected by ADJ Das, however he has issued directions for defendant no.1,2&3. The directions said that while publishing or telecasting any news with regard to this, views of the plaintiff must be taken into, the fact that the final decision is still pending must be conveyed while reporting or publishing or telecasting anything with this regard. Pachauri stands accused of sexually harassing women and had moved an application for injunction restraining media from reporting on the issue saying the same was damaging his reputation.. The counsel for the complainant lawyer and activist Vrinda Grover has said that such an order would defeat the constitutional principle of freedom of speech and expression. She has also pleaded for justification of truth. The court has held that media cannot be restrained by way of injunction, no gag order can be passed by the media in any manner. However the court gave directions with regard to journalistic ethics that needs to be followed.
