Mumbai Court Denies Bail to Doctor accused of Sexually Assaulting COVID Patient.
The Court held the bail rejected which said that accused a 33-year-old Doctor had sexually assaulted a 44-year-old man. Obviously, in such a crises the most trusted and the most needed are the respected Doctors who are simply day and night aiding us. After the case was brought up, there was an immense need of interrogation and then after such interrogation the accused stated that he was been falsely implicated in the matter. The accused is been quarantined and is been dismissed from his duties that is been suspended from the hospital, the police stated. The accused is been charged under Section 377(unnatural offences), 269(negligent when they are high chances of lives being endangered), 270(malignant act likely to spread infection of diseases of endangering life) of the Indian Penal Code. The allegations sought complains which was been registered. The doctor commenced his duty on 30th of April. He was been handling more than eighty cases. On the 1st of May which stated a complain about the patient being sexually assaulted by the doctor at 10:30 A.M. and then the case was put up to the HR. the prosecution at once said the nurse and then went through the written complaint. The statement of the prosecution lay not to be recorded and then granting pre-bail was simply a pressure sought on the victim. The statements of security guard, three doctors and a public relation officer were also recorded. It should also be stated that looking the future conditions of the Pandemic, the doctor committing such a offence is likely a loos too and moreover a trust which is been build up now, is likely to get disturbed. Observing that it could not be a basis for granting pre-arrest bail, the court said the accused should visit and get checked at a hospital nearby. "Considering the egregious and debased nature of the alleged crime, I think that applicant's custodial questioning is appropriate for an effective investigation into the matter," the court further noted.
