On Tuesday, Karnataka High Court ordered the Karnataka State Bar Council and the Advocates Association of Bengaluru (AAB) to initiate disciplinary action against the advocates who gathered in front of the main gate of High Court asking for entry without any prior appointment for physical proceedings.
The order was given by a division bench comprising Chief Justice Abhay Oka and Justice S Vishwajit Shetty. The bench asked for some stringent actions against the advocates as the same situation was created on Monday and the Chief Justice himself had to come to control the situation. The bench said that "Even today at 9.30 am a huge scene was created outside the high court gate, seeking entry. This is against the Standard Operating Procedure issued by the high court, if this continues we will be compelled to close the courts."
The bench orders that "Issue notices of disciplinary action against those lawyers who are creating a scene. Is this not misconduct? When the court issues SOP and there is blatant violation, are you not required to issue notice? Are you helpless?”
Counsel appearing for the State Bar Council said that the advocates acted out of their anxiety and tried to enter the High Court. To which the bench replied that the majority shouldn’t suffer because of the action of minority as the closure of courts would lead to the delay in serving justice. So the council assured the High Court that the same mistake would not happen again and strict actions will be taken against the advocates.
The bench also indicated that it would increase the scope of the suo-moto petition filed to address the different technical and legal problems that the district court could face when the limited functioning of the court starts from June 1 to further include the issue of disregard shown by advocates to Standard of Procedure (SOP).
