The High Court of Jammu and Kashmir observed that the availability of e-connectivity to the courts ensures access to justice to the citizens and the same is a fundamental right which can’t be impeded in any manner. The Chief Justice led bench stated that in these times of restrictions no court can discharge its essential functions without proper e-connectivity.
The bench was dealing with the lockdown situation in J&K and addressing issues like availability of essential commodities and healthcare in the far-off areas of Gurez, Tangdhar, Machail and Uri. The issue of care and support to families of healthcare personnel/government officials engaged in Covid-19 management was also taken up by the bench.
The observation was made by the court in context of an incident of burning of the converter and router installed in a Judicial Magistrate First Class's court in the Udhampur district last month. The argument from the service provider side (BSNL) was that the equipment got burnt due to extension of AC supply directly instead of doing it through UPS by the court authorities. However, the court dispelled this argument by stating that nobody among the court officials could have done it due to lack of knowledge in this field. It appears that the fault is attempted to be fastened unreasonably on the court authorities. The court directed BSNL to install the converter and router in the court and submit an action report within a week’s time.
