On Friday, the Supreme Court asked the centre to consider the suggestions regarding all the parties concerned and decide expeditiously the issue concerning safety standards of quadricycles. A quadricycle is a lightweight four wheeler having mass up to 1500 kg. All the petitioners were asked to place their suggestion before Joint Secretary, Ministry of Road Transport, who shall give them due consideration. This was asked by the bench comprising of Justice UU Lalit and Justice AK Goel. An order was passed by the bench after Additional Solicitor General Pinky Anand submitted that the matters concerning safety standards and emissions by such vehicle are at the final stage of consideration by the Ministry of Road Transport. The court order has explicitly said that the court has permitted the parties to file their suggestion, if any, to Joint Secretary, Ministry of Road Transport, and Central Government within a period of two weeks from today. The above suggestions as per given should be given due suggestion should be finally decided expeditiously. During the hearing of the petitions, the attention of bench was drawn to Rule 2(1) of the Central Motor Vehicles Rules, 1989, which defines category M1 motor vehicles and hence on the above rule the petitioners contended that there was an attempt to reduce the rigour of standards for quadricycles which was not desirable. With this the apex court decided and disposed of several petitions which came before it from across the country related to the sale of small 4 wheelers with a mass up to 1500 kg and quadricycles. According to the original writ petition, such vehicles should be introduced in the market once all the safety emission standards are been lay, so that it may not endanger the safety of all concerned. Towards the safety of the general public, High Court in one of such case passed an interim order directing the central government not to permit such auto manufacturers to release and sell such vehicles. The bench after clearly noting everything had directed the centre to constitute a committee under Dinesh Tyagi, director of Institute of Automotive Technology for framing rules for quadricycles etc and was making a decision in the light of its report. On 29 January this year, the centre also informed “the court that relevant rules/instructions have been worked out for the safety standards for quadricycles”. A copy of notification dated November 24, 2017, with regard to emission standards was also placed on record apart from the draft notification of June 2017 with regard to the safety standards for quadricycles.
