In an unprecedented scenario, a sitting member of the National Green Tribunal has moved the Supreme Court to challenge the appointment of Justice Jawad Rahim as the Acting Chairperson. Justice Raghuvendra Singh Rathore, a judicial member of the green court, opposed the appointment on grounds of supersession.
Justice Rathore, a former judge of the Rajasthan High Court, claimed that he was the senior-most member while Justice Rahim stood third in the list. The Ministry of Environment, Forest and Climate Change had issued a notification on April 5 announcing the interim appointment of Justice Rahim until a new Chairperson is appointed. In light of this, Justice Rathore argued before the Apex Court that this appointment was in contravention of the established conventions that upheld the seniority of judges. The judge stated that on March 27, the SC had ordered the interim appointment of Justice Rahim without giving Justice Rathore the opportunity of objection. Through the plea, he sought to quash this order and also sought an order holding him as the senior-most member qualified for the post of Acting Chairperson.
According to Justice Rathore, the deviation from an established practice of observing superiority would be a disruption in the Rule of Law. He further clarified that he had no personal grievance against Justice Rahim. The Bench, comprising of Justices L Nageswara Rao and Mohan M Shantanagoudar, has scheduled the matter to be heard in the second week of July.
