The Union Law Ministry cleared the names of 7 judges out of 9 recommended by the Supreme Court collegium last year. P T Asha, Nirmal Kumar, Subramonium Prasad, N Anand Venkatesh, G K Ilanthiraiyan, Krishnan Ramasamy and C Saravanan were elevated to the office of Additional Judges in the Madras High Court. This brings the strength of the HC to 63 judges, as against the mandated strength of 75.
Originally, the collegium headed by Madras High Court Chief Justice Sanjay Kishan Kaul had recommended 11 lawyers for elevation, of which 9 were approved by the apex court collegium. Of these, the Ministry approved all except additional public prosecutor C. Emiliyas and Dua Associates partner Senthil Kumar without giving any specific reason. The Apex Court had also refused the recommendation for elevation in the case of 2 lawyers - Mr. B. Pugalendhi and Mr. A.V. Radhakrishnan. While the former was refused on grounds of some ‘unconfirmed adverse inputs’, the latter was found to be outside the prescribed age limit of 55 years for Advocates. The Apex Court had refused to entertain allegations against other recommendees, citing frivolity and triviality. In light of this, the Ministry issued a notification on June 1, 2018 announcing the elevated judges. It is expected that they will be sworn in by Chief Justice Indira Banerjee when the Court resumes after the summer vacation.
