The Bombay High Court dismisses the plea concerning the conduct of the Central Board of Secondary Education (CBSE) and Indian Certificate of Secondary Education Examination (ICSE) examinations in July amid the COVID-19 pandemic (Arvind Tiwari v. Union of India and Ors.)
This matter was posted to await the decision of the Supreme Court on the Public Interest Litigation before it on the conduct of the central board of secondary education exams. Last week, the CBSE informed the top Court that CBSE exams scheduled for July stood canceled.
In the earlier earshot, the Bombay High Court was informed that the CICSE (Council for the Indian Certificate of Secondary Education) would not be conducting examinations in July as originally scheduled given the pandemic.
A division coram of Chief Justice Dipankar Datta and Justice SS Shinde make out through video-conference and dismissed the petition filed by advocate Arvind Rangnarain Tiwari, also the parent of a student from an ICSE-affiliated school. He had sought a court direction to the authorities to cancel the rescheduled exams because of the COVID-19 Pandemic and declare results based on past performances in the papers for which the exams have not been held yet. The High Court also heard an obstruction plea filed by other parents.
The Council submitted that exams for prevailing papers stand abolished and results will be declared by July 15 as per the methodology adopted by it, which will be notified. The CISCE Board also stated that if the situation becomes favorable in near future, it may give students an option to appear for exams at a later date, and the marks in that exam shall be considered as final. The bench declared that the Supreme Court while earshot the plea had noted that all other litigation regarding CISCE and CBSE exams were deemed to be disposed of, thus the PIL before the High Court was also dismissed.
