After the Central Government blocking 59 applications, the Calcutta High Court on Tuesday upheld the state’s ban on the use of Chinese Manjha (A type of a nylon thread coated with powdered glass use for flying kites). The order was passed by the bench of former Chief Justice of Calcutta High Court Thottathil B Radhakrishnan and Justice Arijit Banerjee. These to judges were hearing the PIL with the grievance that kites are being flown with Chinese manjha etc. which pose threat to pedestrianism and motorcycles particularly those who use flyovers for commuting.
The bench also comprising in which Justice Arijit Banerjee, had called the reports from the commissioner of police, Calcutta and also from commissioner department of the environment, the government of West Bengal, on perusal of the court noted that the pursuant to an order passed by the National Green Tribunal, a complete ban has been imposed on the use of Chinese/Nylon/Plastic manjha or thread for kite flying.
‘To this end notification dated 20th March, 2020 bearing No. EN/659/3C-05/2020 has been issued by the Department of Environment, Government of West Bengal invoking section 5 of the environment protection act, 1986 and in compliance with the direction of the National Green Tribunal, observed the bench adding that accordingly the grievance of the writ petitioner stands redressed’.
So, as the complete ban has been imposed on Chinese, nylon, plastic manjha or thread for kite flying which was harming the pedestrianism and motorcyclist particularly who use flyover for commuting. Therefore, disposing of the plea directed that the notification issued by the state government shall be strictly adhered to by the administration and will be given full of its effect. This is the order which should not only be made for one state but for every state because this is harming many of the people and even animals. Therefore, every state government should take harsh action against it and everyone has to strictly adhered to it by the administration and with its full effect.
