It's been a month since it was reported that the known lawyer Sudha Bharadwaj wasn't being allowed to take telephone calls from the Byculla prison, the National Investigation Agency on Wednesday opposed Bharadwaj’s plea for interim bail.
Sudha Bharadwaj is in custody for her alleged involvement in the Bhima Koregaon case, the investigation into which has been highly controversial.
There are pleas made continuously for her release or bail, where court orders are cited and committee recommendations are read to decongest jails within the time of a health crisis.
It was reported that Bharadwaj’s plea for interim bail was earlier rejected by the special court of Mumbai. Bharadwaj has approached the Bombay supreme court with an equivalent plea, which the NIA has opposed saying that the aged unionist who suffers from diabetes and hypertension has been “taking undue benefit of the pandemic”.
The reply of the NIA, quoted by Bar and Bench, also says that on being checked by medical practitioners, Sudha Bharadwaj was found to be in “stable condition and is also being provided appropriate medical assistance within the prison where she is lodged.”
The NIA also said that considering the “gravity of the offense” Sudha Bharadwaj is being prosecuted for, she is not at all entitled to bail, the legal website reported.
It was earlier reported how Bharadwaj’s daughter had been worried over her health, especially as she has been housed during a jail where a minimum of one inmate was found to have been coronavirus positive. “Maaysha says the past two and a half months of the lockdown were spent in making desperate calls to the Byculla jail authorities and find ways to speak to her mother. Each of those calls was met with rude responses or a clear refusal to permit her to attach with Bharadwaj,” the report read.
