The high court of judicature at Delhi in case against YSR congress party and election commission of India issued notices to former two parties in plea seeking de-registration of Andhra Pradesh chief minister Y S Jaganmohan Reddy's Yuvajana Sramika Rythu (YSR) congress party.
In a case filed by Anna Yuvajana Samika Rythu congress party through advocate Vipin Nair and represented by Senior Advocate Meenakshi Arora vouched that present ruling party of Andhra Pradesh ie.., YSR congress party is misappropriating the name before the world at large by stating directly or indirectly that it is an integral part of Anna YSR congress party.
Further, Aggrieved petitioner claimed that despite election commission barring Andhra Pradesh ruling party from naming it as "YSR Congress party" the same is being attached and used illegally, unlawfully in party's letterheads, campaign material and in other pertinent of YSR party.
Petitioner on insisting the court to look upon the clear, willful, pre-mediated, deliberate and conscious disobedience acts overthrowing relevant provisions of law and directions of election commission of India, Anna YSR congress party claimed de-recognition of YSR congress party under claimed de-recognition of YSR congress Party under Para 16A of election symbols order (Reservation and Allotment),1968.
Adding on petitioner also urged that respondent had promised the petitioner that it will further not make use of the name and has broke it. Thereby mentioning about the obligation vested on the ruling party claimed opposite party's renege.
On hearing all the allegations made by the petitioner, Anna YSR party, Single judge bench of Delhi high court comprising Justice Jayant Nath issued notices to both the parties, ECI and YSR party.
Finally posted the matter to 3rd September for next hearing.
