The high court of judicature at madras in the matter N Tamilarasu Vs Home secretary, MHA cautioned its registry to be attentive in writ section so as to curb the further mistakes like re-listing of cases already dismissed.
Late last week, Division bench comprising Justice A P Sahi and Justice Senthil Ramamoorthy came across a Public Interest Litigation which was earlier dismissed in withdrawing the case on June 16th was again listed before the division bench of the same court.
The public interest litigation filed earlier June sought High Court of Madras directions to the state government to impose strict lockdown as the state government to impose strict lockdown as the cases of corona virus infected were increasing at enormous pace. Eventually the matter was dismissed as withdrawn moreover the state government had passed an notification imposing strict lockdown from June 19th onwards.
In view of the above observations the high court of madras pointed out to the lack of coordination in writ section when it came to numbering of petitions filed through e-mail and by physical filing led the public interest litigation already dealt to be numbered afresh attaching same set of documents with same group of counsels.
Therefore, the High court of Madras in division bench insisted the same to not occur again by stating "...the Registry shall take notice of the same and streamline the listing of cases so that no future mistakes are brought to the notice of the court".
While cautioning the registrar the judges also laid down few guidelines that registry has to follow in order to streamline the listing of cases. The guidelines specified that even for filing via e-mail, the hard copies of the case would be numbered after furnishing.
