During a hearing, a special court in Mumbai denied default bail to the activist Gautam Navlakha who is currently filed at Taloja jail. NIA’s application seeking custody of Navlakha for ten days was allowed by the Court for ten days to question him in the Bhima Koregaon case. Judge DE Kothalikar was hearing Navlakha’s application asking default bail under Section 167 of CrPC because he has been in custody for more than 90days.
Also, Judge Kothalikar accepted NIA’s plea asking the extension of 90-180 days to file charge sheet against Navlakha and Dr. Anand Teltubde, accused of being a part of the Maoist movement and provoking the caste-based violence that took place on the 200th anniversary of the combat of Bhima Koregaon speeches at the Elgar Parishad council a day earlier on December 31, 2017. Before the National Investigation Agency, the 67-year-old Navlakha surrendered in April this last year. He was then taken to Tihar Jail after being in NIA’s custody for 10 days. On May 24, NIA moved applications for production warrants before the special court which was allowed. The jail superintendent transferred an application seeking transit order to transfer Navlakha to Mumbai and he was transported via train on May 26. On May 28, Delhi High Court witnessed that prima facie the NIA had acted in acceleration in moving Navlakha from Delhi to Mumbai. Recently, 8 other accused in the case namely Vernon Gonsalves, Varavara Rao, Surendra Gadling, Anand Teltumbde, Mahesh Raut, Rona Wilson, Arun Ferreira, and Sudhir Dhawale are all lodged at Taloja. Whereas, Sudha Bharadwaj and Shoma Sen are kept at Byculla. Navlakha is also being held in reserve at a quarantine facility in Taloja after being brought back from Delhi. Navlakhas partner in conversation with The Hindu said that her conditions at the said facility were deplorable. Advocate Ragini Ahuja argued on behalf of Navlakha and also submitted that the Investigating Agency ha failed to submit the charge-sheet within 90 days.
At last, the Court accepted NIA’s arguments and allowed Navlakha’s custody, denying him bail.
