The Delhi High Court called upon the Tihar Jail officials for detaining a man even after he got bail in the cheque bounce case on May 18. The High Court pulled up the jail authority for failing to release a man from the jail after he got bail.
The Delhi High Court was not okay with the illegal detention of a man even after he got bail. The High Court also passed an order to provide special training to the jailers about their duties. The court also ordered to make arrangements for providing special training to the jail officials regarding the obligations and rights of prisoners.
In the meantime, the jail authorities of the Tihar Jail have offered a genuine apology to the Delhi High Court over the matter.
The matter was listed before the bench comprising Justices Hima Kohli and Subramonium Prasad. The bench ordered for such training for the jail officials. The bench also said that such training is very much needed to prevent a repeat of such incidents again in the future.
The court has further asked the Delhi State of Legal Services Authority (DSLSA) to make the required arrangements for online training for the jail officials. As per the training program the jail superintendents, deputy superintendents, assistant superintendents will be a part of the specialized training program.
The Tihar jail authorities have submitted before the court that they have appointed 14 law officers on a contractual basis to provide the special training to the jail officials.
However, the whole matter is related to a cheque bounce case in which a man was granted bail by a trial court on May 18. But even after he was granted bail, he was released only on June 25 from the jail.
Prior to this, the Tihar officials had submitted before the court that the man was not able to arrange sureties needed to be submitted along with a bail bond. This was the reason he could not be released on time.
Officials further informed that the man could arrange sureties on June 15 and because of this his release was delayed. Thereafter, the court had asked the Tihar jail officials to provide data of prisoners who were released in the last three years.
Rahul Mehra, the counsel for the Delhi government filed a status report in the court tendered an unconditional apology for the irrelevant explanation given by Tihar jail officials for illegally detaining the man.
