Petition filed against congress Chief Sonia Gandhi and Rahul Gandhi:
The Supreme Court on Friday entertained a writ petition filed against Indian national congress in order to seek an investigation by the National Investigation Agency (NIA) under the Unlawful Activities (Prevention) Act, 1967, or, as an alternative, by the Central Bureau of Investigation.
The petition was filled by Goa Chronicle editor-in-chief Savio Rodrigues and Shahshak Shekhar Jha, a Delhi based advocate in the Supreme Court against the Congress leader Sonia Gandhi and Rahul Gandhi who at the time of their government had entered into a memorandum of understanding (MOU) with the Communist Party of China (CPC) on August 7th, 2008. The petitioners claim that this memorandum contained a high level of information and cooperation sharing between them.
The Supreme Court bench headed by THE CHIEF JUSTICE, MR. JUSTICE A.S. BOPANNA and MR. JUSTICE V. RAMASUBRAMANIAN on Friday dismissed the plea and asked the petitioners to approach the high court for this matter.
While addressing the petition the chief justice stated “How absurd! You are saying a political party has entered into an agreement with China?" They remarked these allegations as widely unreasonable and further said that a political party cannot enter into such agreements.
The Supreme Court further stated that they would examine the situation and if the allegations found were untrue, the prosecution would be conducted under this matter and instructed them to file a fresh petition in the high court.
Senior advocate Mahesh Jethmalani appearing on behalf of the petitioners said that the as the matters concerned the whole nation, a writ petition under Article 32 of the constitution of India was filled in order to bring transparency and clarity in this matter. The petitioners seek to dig into investigation under the Unlawful Activities (Prevention) Act, 1967 which is meant to outlaw terrorist activities.
Further, they mentioned that even though the Right to Information Act was enacted during the rule of Congress party, they have failed to adhere to this act.
The petition stated that the MOU was signed even though India and China had tense relations.
