In accordance with the directions issued by the Karnataka High Court, it was ordered by the Union Ministry of Water Resources that whenever a decision is taken by the State/Union Territory Government/Authority/ Dam Authority to release water from reservoirs or damns within its limits, immediate intimidation has to be given regarding same to the State/ Union Territory.
Government/ Authorities/ Dam Authorities that are adjacent to the State/Union Territory are likely to be affected by the release of water from reservoirs or dams. The Central Government is represented by Advocate Kumar M N before the court, he filed the memo informing about the order issued on 9th August 2020.
The memo states that, "the decision to release water shall be communicated sufficiently in advance by the concerned States/Union Territories/ Government/ Authority in order to allow mitigation measures to be set up by the downstream State/UT/Government/Authorities/Dam Authorities against any impending flood situation which could be caused due to the release of water from damns/reservoirs."
It was directed by Justice Abhay Oka to authorities to consider exercising the powers under clause (I) of sub-section 2 of section 10 of the Disaster Management Act, 2005, by issuing the directions to the State Government and State Authorities mandating them to give intimidation to the States who are adjacent to the States where water is going to be released from dams and reservoirs and are likely to be affected by the release so that the State Government can be prepared.
The Chairmen of the National Executive Committee (NEC) passed the order following the directions given by the High Court on 24th July 2020, in compliance passed an order under Section 69 of the Disaster Management Act, 2005.
The petitions state that it is high time for the State and Centre to respond before the calamity of the flood happens and can use the technology to forecast the situation and can be prepared accordingly.
