The Karnataka High Court bench comprising Justice KN Phaneendra has held on 27th June that mere intention or preparation to commit suicide would not constitute an offense till there was an actual attempt at it. In the abovementioned case, Kaviraj had attempted to commit suicide. However, the court observed that there was no material record to show that he had actually intended and attempted to commit a suicide. A person’s want to commit suicide and his actions at committing suicide are two different things. The court further observed that Section 309 of the IPC specifies for the suicide to be actually committed and a person’s subsequent survival and not the mere preparation of it. Previously, there had been moves by the Central government to scrap Section 309 of the IPC which criminalizes the “attempt to suicide” however, no amendments have been introduced yet.
