The Court took note that the Tribunal found out under the upkeep and Welfare of oldsters and Senior Citizens Act, 2007 has not been functioning since March 2020 on account of the COVID-19 pandemic.
The Bombay HC Bench of Justices Nitin Jamdar and MN Jadhav has directed the government to appraise it of when the Tribunal established under the upkeep and Welfare of oldsters and Senior Citizens Act, 2007 is predicted to start functioning, virtually or through physical sittings.
The Court was hearing a plea moved by Subhash Ramnath Pandey, an oldster, for directions against his son.
Pandey submitted that he had moved to the high court for aid because the Senior Citizens Tribunal hasn't been working.
The Court refused to think about Pandey's plea for directions against his son, noting that the matter may be a domestic one concerning disputed facts which the parties can raise before the acceptable Tribunal.
The Court observed the larger concern of the Tribunal having been closed since March this year. It said,
"...the Act of 2007 may be a beneficial legislation, enacted for providing succour to the senior citizens who may suffer due to the neglect by their children. There would be many such senior citizens who would be within the need of quick redressal. Various authorities have resumed functioning physically or through video conferencing way back, there's no reason for this Tribunal to still be closed."

The Court clarified that it'll not check out the inter se dispute between the parties to the case. Although, for the limited purpose of issuing directions to the State on the aspect of restarting the functioning of the Senior Citizens Tribunal, Pandey has been directed to implement the State as a respondent to his plea.
The Court has directed the government Pleader to require instructions from the concerned Secretary of State beforehand before the subsequent date.
The matter is going to be next heard on October 15, 2020.
